Withdrawal Policy

Note: This withdrawal policy is addressed to consumers within the meaning of Section 13 of the German Civil Code (BGB). Businesses (traders) within the meaning of Section 14 BGB have no statutory right of withdrawal.

Right of withdrawal

You have the right to withdraw from this contract within 14 days without giving any reason.

The withdrawal period will expire after 14 days from the day of the conclusion of the contract.

of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post or e-mail). You may use the attached model withdrawal form, but it is not obligatory.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Effects of withdrawal

If you withdraw from this contract, we shall reimburse to you all payments received from you without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.

Premature expiry of the right of withdrawal

Digital content (download licenses, music files, ASM mixes). In the case of a contract for the supply of digital content which is not supplied on a tangible medium, your right of withdrawal expires when we have begun performance of the contract after you

  1. have expressly consented to our beginning performance of the contract before the expiry of the withdrawal period, and
  2. have confirmed your knowledge that, by giving your consent, you lose your right of withdrawal upon commencement of performance of the contract, and
  3. we have provided you with a confirmation pursuant to Section 312f BGB.

Free offerings. There is no right of withdrawal for the SIDtunez Radio and the free license, because no payment is agreed; the statutory right of withdrawal for distance contracts requires a performance provided against payment.

This policy is based on the statutory model withdrawal policy (Annex 1) and the model withdrawal form (Annex 2) to Article 246a Section 1(2) of the Introductory Act to the German Civil Code (EGBGB), adapted to digital content and services.
